SURRENDERING YOUR SCOTTISH TERRIER agreement terms and conditions:
(hereinafter referred to as the “Scottish Terrier”).
1. REPRESENTATIONS & WARRANTIES – Transferor represents and warrants as follows:
a)The undersigned is/are the sole owner(s) of the Scottish Terrier and no other person or persons have any legal or equitable ownership interest in the Scottish Terrier.
b)The undersigned is/are the only person(s) who are listed as registered owner(s) of the Scottish Terrier with the American Kennel Club (“AKC”). No other person or persons’ signatures are required to effect a valid transfer of AKC registration papers on the Scottish Terrier.
c)Transferor has full power and authority to surrender the Scottish Terrier for adoption.
d)The Scottish Terrier is in reasonably good health, has had regular veterinary care, and has current immunizations. The Scottish Terrier does not have a history of biting or causing injuries to children or other animals and is otherwise suitable for placement in an adoptive home.
e)Transferor is entering into this Agreement freely and without coercion or duress, s/he has read the terms of this Agreement, he fully understands those terms, and s/he has consulted with his or her chosen attorneys regarding any and all questions that s/he might have regarding the terms of this Agreement
2. DELIVERY OF REGISTRATION - Transferor agrees to (contemporaneously with the execution of this Agreement) (within three days) deliver to STLSTR a properly signed transfer of the AKC registration papers for the Scottish Terrier, omitting the name of the transferee. Transferor hereby designates and authorizes STLSTR as his/her agent and attorney-in-fact for purposes of designation a transferee and inserting this name on the AKC registration transfer form.
3. OTHER PERTINENT INFORMATION – Upon request, Transferor agrees to provide STLSTR complete, truthful, and accurate information and available documentation concerning this Scottish Terrier which might assist in matching the Scottish Terrier with the proper prospective adoptive home, including but not limited to health and shot records, pedigree, name and address of breeder or other person from whom the dog was acquired, and information concerning the Scottish Terrier's "dog history," such as important life events and individual personality quirks. Transferor further agrees that this information may be disclosed to any person as deemed necessary and appropriate by STLSTR.
4. CONSENT FOR CONTACT - Transferor understands that STLSTR may contact the breeder or previous owner of the Scottish Terrier to provide additional background information, or otherwise assist in locating a suitable adoptive home and hereby gives his/her consent to these efforts.
5. SURRENDER OF RIGHTS – Transferor acknowledges that the effect of this Agreement is to transfer all of his/her right, title and interest in the Scottish Terrier to STLSTR. By executing this Agreement, Transferor acknowledges that s/he is giving up forever all right, title and interest to the Scottish Terrier and that all future decisions regarding the care and placement of the Scottish Terrier will be made solely by STLSTR.
Transferor agrees that if the Scottish Terrier is later found to have such an unpredictable temperament as to be unsuitable for any placement, or if its quality of life is substantially impaired, in the opinion of a competent veterinarian to be selected by STLSTR, by a chronic, irreversible, painful condition, euthanasia may be considered as a final alternative to adoptive placement.
6. RELEASE, AND INDEMNITY – Transferor does hereby fully release, acquit and forever discharge STLSTR and its officers, directors, members, employees, insurers, agents, representatives and assigns (collectively, the “Indemnified Parties”) from any and all liability relating to or arising out of the placement for adoption by STLSTR of the Scottish Terrier, or for any other actions taken by STLSTR in accordance with, and in reliance on, the representations made herein, and the authorizations provided under the terms of this Agreement. Transferor further agrees to indemnify, defend and hold harmless the Indemnified Parties from and against any and all claims that may be brought by any person or organization, whether for bodily injuries or death, property damage, breach of contract, or otherwise, arising out of or in consequence of the placement of the Scottish Terrier, to the extent such claims relate to or arise out of the representations and warranties made herein. Transferee expressly agrees to pay any damages suffered and expenses incurred by STLSTR (including legal fees) in defending against any third-party claims.
7. ENTIRE AGREEMENT - This Agreement constitutes the entire agreement between the Parties and all prior negotiations, promises and representations and statements of fact and/or opinion are merged into this Agreement.
